Verification of data correctness

Who must submit a CBAM report?
CBAM reports are required to be submitted by entities involved in the import of high-emission goods:
- importers of products from commodity groups such as cement, steel, aluminum, artificial fertilizers, hydrogen and energy,
- customs agencies acting as an indirect representative of an importer based outside the EU.
CBAM reports may be simultaneously submitted by:
- customs agencies acting as a direct or indirect representative of an importer based in the EU,
- companies dealing with ESG, environmental protection, tax offices that serve their clients in the field of CBAM.
What is subject to CBAM reporting?
The reporting obligation rests with the importer of high-emission goods or a customs agency that acts on behalf of the importer on the basis of indirect representation, and the importer is not based in the European Union. If the importer is based in the European Union or the customs agency acts as a direct representative, then it may consent to the submission on behalf of the importer, but is not obliged to do so.
All goods covered by CBAM carbon border tax reporting belong to the following categories of goods: hydrogen, steel, iron, aluminum, artificial fertilizers, cement, electricity. At the same time, not every product from the above groups of goods is subject to reporting. You can check whether a given product is subject to reporting obligations based on the customs codes you find here .
The above-mentioned goods are subject to mandatory reporting if they were produced outside the European Union and the countries included in the European Economic Area, i.e. Norway, Switzerland, Liechtenstein and Luxembourg.
Not every shipment must be subject to mandatory reporting. The minimum value of the imported product must be EUR 150 per shipment. Goods imported for the military authorities of the European Economic Area Member States, purchased within the framework of the EU's Common Security and Defence Policy and NATO, are also not subject to the reporting obligation.

CBAM carbon border tax - calendar
In October 2023, the CBAM regulation entered into force. Pursuant to its provisions, each entity that imports into the European Union high-emission products from the group of goods such as cement, steel, aluminum, artificial fertilizers, hydrogen and energy is obliged to submit quarterly reports relating to the emission intensity and production methodology of these goods.
January 2024 was the first month of mandatory CBAM reports that had to be submitted for the last quarter of 2023. The next deadline was in April 2024. Importantly, if you noticed any irregularities in the submitted reports, you must correct them by July 2024.
This is important because in case of errors, or even worse, failure to submit the CBAM report, your company may face a financial penalty ranging from 10 to 50 Euro per 1 ton of unreported emissions. The amount of fines does not seem excessive, but customs inspections of your imports may prove to be a much bigger problem. Subsequent quarterly CBAM reports are due by the end of July and the end of October.

'CBAM Authorized Declarant' status and CBAM certificates
In January 2025, the regulation requires entities to register in the CBAM register as a CBAM Declarant. This means that any importer of high-emission goods qualifying under the CBAM regulation will have to obtain this status in order to import CBAM goods in 2026.
In January 2026, the second stage of the CBAM regulation will enter into force, which assumes not only reporting, but also the need to purchase CBAM certificates that will correspond to embedded emissions. From now on we will be dealing with an actual CBAM carbon border tax.
