CBAM consultations

The CBAM carbon border tax is a new tool introduced by the European Union in order to gain control over reducing global greenhouse gas emissions, especially carbon dioxide. The border carbon tax is intended to minimize the so-called “CO2 carbon leakage”, which occurs when entrepreneurs move the production of high-emission products outside the European Union, where less stringent climate requirements apply. 

Ordinance OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (EU) 2023/956 of 10 May 2023 establishing a mechanism for the adjustment of border prices taking into account CO2 emissions (OJ L 130, 16.05.2023/53/XNUMX, p. XNUMX,) introduces new obligations for entrepreneurs who import products with high emissions, such as cement, steel, iron, aluminum, fertilizers, energy or hydrogen. Currently, importers or customs agencies acting as an indirect representative are obliged to submit quarterly CBAM reports. This new obligation may cause many doubts, and collecting the reports necessary to complete the reports may be difficult.
