If you are an importer of high-emission goods, such as products from the customs group cement, energy, steel, aluminum, iron, artificial fertilizers or hydrogen, you are obliged to submit quarterly CBAM reports. This obligation was introduced by the Regulation OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (EU) 2023/956 of 10 May 2023 establishing a mechanism for the adjustment of border prices taking into account CO2 emissions (OJ L 130, 16.05.2023/53/XNUMX, p. XNUMX), whose aim is to identify the amount of high-emission goods imported into the EU.

When must a CBAM report be submitted?
The CBAM Regulation obliges entrepreneurs to submit CBAM reports from 2024. The first quarterly CBAM report was to be submitted by January 31, 2024 for the period from October 01.10.2023, 31.12.2023 to December 3, 2024. The next report for the first 30.04.2024 months of XNUMX was due by April XNUMX, XNUMX. Importantly, reports must be submitted quarterly:

If you have not submitted CBAM reports in previous reporting periods, you must have the request number of the appropriate authority. In the case of Poland, this is the National Center for Emission Balancing and Management (KOBiZE). What are the penalties for failing to submit a CBAM report?
The CBAM Regulation provides for the possibility of imposing financial penalties on entities that have not submitted or submitted an incorrect CBAM report. Currently, i.e. until 2026, i.e. until all provisions of the Regulation enter into force, these penalties may range from EUR 10 to EUR 50 per tonne of unreported emissions. However, border controls on your imports or the inability to obtain the status of an "authorized declarant" may be more severe, which will result in the inability to import products subject to the CBAM obligation into the European Union.
